Terms and Conditions
1. Cerka provides its services in accordance with the principles outlined in this Terms and Conditions document.
2. By agreeing to these Terms and Conditions, the user confirms that they have read, understood, and accepted the content in full.
3. Acceptance of these Terms is a mandatory requirement for using Cerka’s services.
4. All users are expected to comply with these Terms throughout their use of the platform.
5. Cerka reserves the right to update or amend these Terms and Conditions at any time, at its sole discretion.
6. If any changes are deemed significant, Cerka will provide a minimum of 14 days’ notice before the revised Terms come into effect. What qualifies as a “material change” will be determined exclusively by Cerka.
7. Continued use of the services after such changes have been implemented will be considered as acceptance of the updated Terms.
If a user does not agree to the revised Terms and Conditions, they will no longer be permitted to use Cerka’s services.
Services description
1. Cerka retains full discretion over the features, scope, and availability of its services, products, and applications. This includes the right to modify, expand, limit, or discontinue any part of the offerings at any time.
2. Cerka also has exclusive authority over the design, content, and structure of its software. This includes the freedom to add, alter, or remove specific elements without prior notice.
3. Please note that the materials provided through Cerka's services may occasionally contain technical inaccuracies or typographical errors. Cerka does not guarantee that all content is accurate, complete, or up to date. While Cerka may revise or update content at its discretion, it is under no obligation to do so.
4. Any use of newly introduced products or features following the acceptance of these Terms and Conditions will also be governed by the provisions contained within this agreement.
Access and the use of Services
1. Cerka's services are intended exclusively for business use and must be utilized only in accordance with their intended purpose, functionality, and overall characteristics.
2. Access to the services is provided solely through Cerka’s official websites and applications.
Each user is assigned a unique login and password, which must not be shared with or used by third parties without the user's explicit permission. Users are solely responsible for maintaining the confidentiality and security of their login credentials.
3. By using the services, the user agrees to do so in a manner that aligns with their intended use, complies with these Terms and Conditions, and adheres to applicable laws and regulations.
4. Users assume full responsibility for any content, messages, or data they submit or transmit while using the services.
5. Users acknowledge that they understand and accept the technical requirements needed to access and use the services, and they accept the potential risks associated with electronic data transmission.
6. Cerka reserves the right to access individual user accounts for technical, administrative, or security-related reasons. Any information obtained through such access will not be processed or disclosed to third parties, unless required by law.

Service Quality and Limitations of Liability
1. Cerka is committed to maintaining a high standard of service performance to ensure the availability and continuity of its services, in line with their intended use and purpose. However, due to the nature of long-distance data transmission, absolute guarantees regarding security, uninterrupted access, or constant availability cannot be provided.
2. Cerka does not guarantee that its services will be fully compatible with third-party software. Users are solely responsible for the selection and use of any external software, including ensuring it aligns with their needs and objectives.
3. Cerka does not monitor or moderate messages exchanged between users (such as operators and their customers). The sender of a message is fully responsible for its content. The use of the services to share or transmit discriminatory, hateful, pornographic, or pedophilic content is strictly forbidden.
Cerka shall not be held liable for the following:
a) Any adverse consequences resulting from force majeure events,
b) Content, phrases, or data submitted via the network while using the services,
c) Any unlawful or non-compliant actions by users in breach of these Terms and Conditions,
d) Service interruptions not caused by Cerka,
e) Damages incurred due to account suspension or closure, whether initiated by the user or resulting from the user's actions,
f) Damages resulting from unauthorized third-party access using the user’s credentials,
g) Losses arising from the use or inability to use the services, including but not limited to actual damages, loss of anticipated profits, data loss, system malfunctions, costs associated with alternative software or hardware, downtime, or harm to business reputation,
h) Consequences of other users failing to fulfill obligations, even when those obligations were established using Cerka’s services.
Cerka strictly prohibits any form of inappropriate or unlawful content. This includes, but is not limited to, offensive language, pornography, threats, or any other content that may be considered abusive, harmful, or in violation of applicable laws.
Users who engage in such activities will be subject to account suspension or permanent removal.
Cerka reserves the right to review and take action against any violations. Confirmed offenders will be removed within 24 hours of detection.
